Terms of service

These terms apply to tontria.com and to every TONTRIA product (the “Services”): TONTRIA Clips (clips.tontria.com), TONTRIA AI, and the TONTRIA suite — TONTRIA for Labels, for Management, for Publishers, for Artists, for Producers, TONTRIA Studio and TONTRIA Analytics — including their websites and apps. A product may have additional terms (for example, the plans, credits and refund rules of TONTRIA Clips on clips.tontria.com); for that product, they apply together with these terms and prevail if they differ.

1. Who we are

The Services are operated by MUSICA & ENTRETENIMIENTO SRL (“TONTRIA”, “we”, “us”). Contact: tontria.ai@gmail.com. By creating an account or using the Services you accept these terms and our privacy policy. If you use them on behalf of a company, label, management or artist, you confirm that you can accept these terms on their behalf.

2. Your account

You must be at least 13 years old (or the minimum age where you live) and give accurate information. Keep your access details safe: you are responsible for what happens in your account and in the workspaces you manage, including the activity of the people you invite.

3. Your content

Your music, videos, files and information remain yours. You give TONTRIA a limited licence to host, process and transmit them only to provide the Services to you — for example to create clips, to answer you with AI, or to publish a video where you asked us to. You may only use content you own or have permission to use, including the permissions of labels, publishers, performers and the platforms it comes from. We do not use your content to train AI models.

4. AI features

AI features can make mistakes. Review suggestions, texts, summaries and figures before relying on them. Actions that send, publish or change something outside TONTRIA — an email, a post on a social platform — only happen when you confirm them or schedule them yourself.

5. Connected accounts and publishing to social platforms

You can connect accounts you own or manage on YouTube, TikTok, Instagram, Facebook (Pages), LinkedIn and X so that TONTRIA publishes the videos you choose, with the text and settings you choose, right away or at the time you schedule. TONTRIA never publishes anything you did not send or schedule, and never posts on its own.

• You are responsible for what you publish and must follow the rules of each platform. By using the YouTube features you agree to be bound by the YouTube Terms of Service; Google’s privacy policy is at policies.google.com/privacy. When you post to TikTok you also accept TikTok’s Music Usage Confirmation (and, for branded content, its Branded Content Policy). Instagram and Facebook posts are subject to Meta’s terms.
• Each platform decides whether it accepts, limits, labels or removes a post. We are not responsible for those decisions, and a platform may stop allowing apps to publish at any time.
• You can disconnect an account at any time from the app, or remove TONTRIA from the platform’s settings. See data deletion.

6. Acceptable use

Do not use the Services to break the law; to upload, create or publish content that infringes copyright or other rights, that is defamatory, hateful, harassing or sexual content involving minors; to impersonate someone; to send spam or post in bulk without real people behind it; to break the terms of the platforms you connect; or to attack, overload, scrape or get around the limits and security of the Services. We may remove content and suspend or close accounts that break these rules, and we cooperate with rights holders and the authorities when the law requires it.

7. Plans, credits and payments

Prices are in US dollars and are shown on each product’s website before you buy. Paid plans renew automatically until you cancel. Some products use credits; their rules are shown on that product’s pricing page. Payments are processed by Creem, our Merchant of Record, which charges your card and handles taxes and invoices. Refunds follow the refund policy of the product you bought (for TONTRIA Clips, clips.tontria.com/refunds). Early-access products may change before billing starts; we will tell you before charging you anything.

8. Availability and changes

We work to keep the Services available and your files safe, but we do not guarantee they will be uninterrupted or error-free; keep your own copies of your original files. We may change or remove features; if a change significantly affects a paid plan, we will tell you in advance.

9. Liability

The Services are provided “as is”. To the extent the law allows, TONTRIA is not liable for indirect damages, lost profits or lost data, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits the rights you have as a consumer under the law of your country.

10. Ending your use

You can stop using the Services and delete your account at any time (see data deletion). We may suspend or close accounts that break these terms.

11. Governing law

These terms are governed by the laws of the place where MUSICA & ENTRETENIMIENTO SRL is incorporated, and its courts have jurisdiction, without prejudice to the mandatory consumer protections of your country.

12. Changes to these terms

If we change these terms, we will update the date above and, for important changes, tell you in the app or by email before they apply.
